Talk to a lawyer about whether you have rights under the Affidavit of Support

Our story.

Sound Immigration was founded a decade ago near Seattle, Washington. Our practice originally focused on traditional family-based immigration, such as marriage-based green card applications and immigrant visas.

In 2012, founding attorney, Greg McLawsen, co-authorized a short article for a local bar newsletter about an immigration document termed the Affidavit of Support. This document was little known outside the immigration community. The article cautioned family law attorneys to be cautious about the Form I-864, because it entailed significant financial obligations for spouses – and others – who served as family-based immigration petitioners.

Greg’s short article evolved into a lengthier journal article that examined every U.S. case involving enforcement of the Affidavit of Support. That article and the three that followed are available for free download on our website.

As described in the articles, the law surrounding enforcement of the Affidavit of Support is very strongly behind sponsored immigrants (i.e., the green card holders enforcing rights under the Affidavit). Yet virtually no lawyers in the entire country focused much energy on these cases. Immigration lawyers tend not to wade into litigation against private parties; family law attorneys and general civil litigators generally have little knowledge of immigration law. As a result, green card holders with who seek advice about their rights under the Affidavit of Support often find it impossible to find a lawyer with experience in such matters.

And so our phone started ringing.

We were contacted by green card holders from all across the United States who were unable to find a local attorney willing to help them enforce the Affidavit of Support. Worse yet, many were told by local attorneys that it was impossible to enforce the Form I-864, or that the rights were not valuable.

Over the years, we found ourselves helping more and more clients, in states across the country, enforce the Affidavit of Support. We partnered with law firms from California to North Carolina to ensure that we had local attorneys available to assist in litigation.

As the years went by, we focused more on enforcement of the Affidavit of Support. Today, helping green card holders enforce the Form I-864 is the primary focus of our practice. To our knowledge, we have represented vastly more plaintiffs in I-864 enforcement lawsuits than any other law firm anywhere in the country.

  1. I left my abusive American husband and called police on him and he got arrested. He’ll soon file divorce. He’s rich and I’m not .He can hire the best Attornies. I’m on a conditional green card .
Can he call USCIS or I.C.E and claim he is a victim of a marriage fraud hence they remove me from United States?

    1. Hi, Anita:
We should talk to see if you have a potential claim for support under the USCIS Form I-864, Affidavit of Support. But that aside, no, there is almost no chance that your husband is going to be able to get you deported, unless you committed an actual act of marriage fraud. If he’s just angry and vindictive, that’s not going to go anywhere with ICE.
      ~Greg
