Examples of published litigation outcomes
When required to advance our clients’ claims, we offer full-scope representation in federal lawsuits to enforce the Affidavit of Support. The following are examples of landmark rulings we have achieved for clients that resulted in published decisions.
Asilonu v. Okeiyi, 550 F.Supp.3d 282 (M.D. N.C. 2021). The Court granted our motion for judgment on the pleadings, ruling that that common law affirmative defenses are categorically unavailable to Affidavit of Support defendants.
Pachal v. Bugreeff, 495 F. Supp. 3d 963 (D. Mont. 2020). The Court denied a defendant-sponsor’s motion to dismiss our client’s Affidavit of Support enforcement action, agreeing with our argument that the client’s claim was federal in nature and nor subject to a procedural barrier called “abstention.”
Cyrousi v. Kashyap, 386 F.Supp.3d 1278 (C.D. Cal. 2019). The Court granted in part our client’s motion for summary judgment, ruling that traditional contract law defenses are inapplicable in such enforcement actions.
Rahman v. Chen, 281 F. Supp. 3d 1124 (W.D. Wash. 2017). The Court granted our motion to dismiss counterclaims asserted by the Affidavit of Support sponsor, ruling that federal jurisdiction did not extend to those claims and thus streamlining our client’s lawsuit.
Dorsaneo v. Dorsaneo, 261 F.Supp.3d 1052 (N.D. Cal. 2017). The Court granted our motion for partial judgment on the pleadings, favorably limiting the issues at stake in the litigation.
Liu v. Kell, 299 F.Supp.3d 1128 (W.D. Wash. 2017). The Court granted our motion for partial summary judgment, dismissing defenses of res judicata, failure to mitigate and waiver.
Khan v. Khan, 332 P.3d 1016 (Wash. Ct. App. 2014). This first-ever lawsuit in Washington established that the beneficiary of the Form I-864 has standing to enforce her private right of action for financial support.
